City Staff to Propose A Change to Palm Aire’s “Dashed-Line” Land Use Plan Category
The distribution of the 10,631 residential units in Palm Aire has been governed by a court approved “Stipulated Settlement Agreement” (SSA) since 1985. The SSA served to resolve issues between the Developer of Palm Aire and the City with regard to the permissible density of the parcels remaining to be developed at that time. The city and county Comprehensive Land Use Plans already had Palm Aire designated as a dashed-line land use category with an irregular density of 7 dwelling units per gross acre prior to the adoption of the SSA. At the time the SSA was approved by the courts, 6,420 of the units in Palm Aire (60% of the total) were already built. Since the SSA became effective in 1985, the remaining 4,211 units in Palm Aire have been allocated.
The purpose of the dashed-line land use category and the SSA was achieved with the allocation of 100% of the residential entitlements and, therefore, is no longer needed. City staff is proposing to change the land use category for Palm Aire from a “dashed-line with a fixed number of units” to a traditional land use approach. This involves placing the appropriate land use designation on each development parcel that most closely matches the actual constructed density.
This change in land use methodology only affects the residential parcels in Palm Aire. The parcels with an underlying commercial and recreational designation (most predominantly the remaining golf courses) are not being changed by this application.
