Pompano Beach voters will be asked to decide three ballot questions for the November 5th General Election.

The proposed Charter amendments would modify the Charter to make inconsistent provisions dealing with ordinances and resolutions consistent with state law and to provide greater flexibility to conduct City business.



PROPOSED AMENDMENT #1

REMOVING EMINENT DOMAIN FROM THE CHARTER AS A REQUIREMENT FOR PROPERTY TRANSFERS TO GOVERNMENTAL ENTITIES.

Shall the power of eminent domain requirement be removed from Section

253 (h) of the Pompano Beach City Charter?

PROPOSED AMENDMENT #2

APPROVING CONTRACTS BY RESOLUTION AND FOR TERMS LONGER THAN FIVE YEARS WITH CITY COMMISSION APPROVAL.

Shall the contract provisions of the Pompano Beach City Charter [Section 251 (c)] be amended to allow contracts to be approved by resolution consistent with state law, and shall the term of such contracts be permitted to exceed five (5) years if approved by the City Commission?

PROPOSED AMENDMENT #3

APPROVING LEASES BY RESOLUTION AND FOR TERMS LONGER THAN FIFTY YEARS WITH CITY COMMISSION APPROVAL.

Shall the lease provisions of the Pompano Beach City Charter [Section 250 (a) and (b)] be amended to approve leases of City-owned property by resolution consistent with state law, with two (2) public hearings for approval, and shall the term of such leases be allowed to exceed fifty (50) years if approved by the City Commission?

  • Ordinances are used to make laws per [Section. 166.041, Florida. Statutes].
  • Resolutions are used to handle administrative matters such as approval of leases and contracts per [Sect. 166.041, Florida Statutes].
  • The Pompano Beach City Charter currently requires that leases of City property and some contracts be approved by ordinance.
  • The City Charter limits leases to 50 years, an arbitrary term that prevents necessary flexibility.
  • The City Charter limits contracts to 5 years, an arbitrary term that prevents necessary flexibility.
  • The City wants the flexibility to lease property for terms that make the most sense for the City, and to set the terms of contracts with City Commission approval.
  • State law has changed to substantially limit the power of eminent domain of governmental entities, therefore requiring the power of eminent domain no longer makes sense as a condition for transfer of City property to other governmental entities.
  • The City, in any event, will obtain all CRA property at the conclusion of the life of the CRA.
  • The City has always recognized the need to transfer City property to the CRA. [City Code Section 38.04 re City delegation of powers to the CRA.]

General Election Information

Municipal Elections are held every two even numbered years in November concurrent with county-wide General Elections.

The Pompano Beach City Commission is comprised of six members, the Mayor and five Commissioners. The Mayor is elected at-large for a four year term and each commissioner is elected by district for a two year term. Candidates for municipal office must file the appropriate forms with the City Clerk prior to opening a campaign account and to qualify for office. Elections are conducted in accordance with the provisions of the City Charter and Florida Statutes. For further information please call the City Clerk’s office at 954-786-4611.

Qualifying for Office

Pursuant to Section 7, Article II of the City’s Charter, Candidates shall have been residents of the election district from which they are elected for at least one (1) year immediately preceding their election. They shall have the qualifications of electors in the city and shall be registered to vote in the city. They must continue to reside during their term of office in the respective election district from which they are elected or appointed.

Qualifying and Assessment Fees

An amount equal to 1% of the annual salary of position sought plus $50 City filing fee (Sections 99.092(1) and 99.093(1) , F.S.). The fees must be paid by a check drawn from the campaign checking account. Polling Places within the City are designated by the Broward County Supervisor of Elections, from 7:00 a.m. until 7:00 p.m. (Eastern Standard Time). For information about registering to vote or general voting procedures, please contact the Broward County Supervisor of Elections' Office at 954-357-7050 between 8 am and 5 pm, Monday though Friday.
